Judicial Tyranny is when the courts - judges overstep their boundaries and make laws that override the legislative branch of Government.
I think it was Thomas Jefferson, or was it James Madison, I can't remember which one was worried about a Supreme Court with Judges appointed for life who could in essence override the legislature as well as change the US Constitution without a legislative process. In other words, a Judicial Tyranny.
In the US we are set up as a Republic and not a true democracy. We elect representatives to represent us to congress and elect a President too. Each branch of the US Government can check and balance each other, thus preventing a dictatorship, or one branch of Government becoming more powerful than another.
How ever, in out Court system, this check and balance system is not there. A Judge in a high court can make a rule and subvert the will of the people as well as enact laws that would never pass in the legislative process: that is Judicial Tyranny…
If I recall correctly, on the Communist Party of America web site as well as from documents they have wrote. They point out this weakness and seek to exploit it to enact laws that benefit their ideology and goals as these would never pass in the legislative process.
One well known goal of both communist and socialist progressives is to destroy religion and the traditional family in order to remake a Utopia. To acheive this, they pit classes of people against each other. Sort of a
Conflict Theory approach as well as a
Scapegoat approach is used, and add in a new form of
Group Think i.e. Political Correctness one can bring down the evil traditional society norms that enslave the masses etc and etc claptrap…
Evolutionary Socialism (Fabian Socialism) attempts to slowly pound away toward their Utopian vision by use of Judicial Tyranny enacting laws that if voted on by the people, would never see the light of day.
Think of Judicial Tyranny as court judges making all the laws based on whatever whim of the judge. Think of the concept of the '
Divine Right of Kings' and there you'll find a better definition and example of Judicial Tyranny…however with many kings...
The Judiciary ruling the Legislature...without any checks or balances…
